RE: COUNTRY OF ORIGIN MARKING OF CHAIRS

Dear Mr. Zisser:

This is in response to your letter dated March 20, 1999, on behalf of Anderson Desk, Inc., requesting a ruling on the country of origin marking requirements for chairs assembled in the United States from a combination of components from Mexico and the United States.

Anderson Desk, Inc. is a manufacturer and distributor of wooden office furniture, including desks, tables, file drawers, cabinets and chairs. The company proposes to produce a high quality line of padded and upholstered office chairs known as the “Bank of England.” These chairs are assembled in the United States from a combination of United States and Mexican components. The ten components include:
cut to shape 3/4 oz. polyester fiber cut to shape amoline black cut to shape upholstery fabric or upholstery leather padded and covered chair back four metal chair glides decorative nails wooden leg frame cut to shape 1 1/2 inch polyester foam cut to shape 1 1/4 inch polyester foam cut to shape matrex fabric

In the United States all ten components will be assembled into a finished Bank of England chair. Photographs depicting the finished chair and the assembly process were submitted with your request.

On the basis of the information provided, pursuant to section 134.35(b), Customs Regulations, the chair components are assembled so as to become a good of the U.S. Because the country of origin marking rules are not applicable to goods of U.S. origin, it is not necessary to mark the subject chairs after their production in the United States.

This ruling is being issued under the provisions of Part 181 of the Customs Regulations (19 CFR Part 181).
