RE: The tariff classification of infants= and girls= knit jackets from Macau

Dear Mr. Imbrogulio:

In your letter dated January 29, 1999, you requested a tariff classification ruling.

The submitted samples, which will be imported as styles BN50088, ON50088, NLG50088, and NBG50089 depending on the size, are infants= and girls= knit jackets constructed from 65% polyester, 35% cotton finely knit fabric that is napped on the inner surface. The jackets feature a hood, a full front zippered opening, long hemmed sleeves, two front slash pockets located below the waist, and a hemmed bottom. The garments will be imported as style BN50088 in infants= sizes 9 to 24 months, style ON50088 in girls= sizes 2T to 4T, style NLG50088 in girls= sizes 4 to 6X, and style NBG50089 in girls= sizes 7/8 to 14/16.

Your samples will be returned as requested.

The applicable subheading for the infants= jacket, style BN50088, will be 6111.30.5040, Harmonized Tariff Schedule of the United States (HTS), which provides for babies= garments and clothing accessories, knitted or crocheted: of synthetic fibers: other: other: other. The rate of duty will be 16.5% ad valorem.

The applicable subheading for the girls= jackets, styles ON50088, NLG50088, and NBG50089, will be 6102.30.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for women=s or girls= . . . anoraks . . . knitted or crocheted, other than those of heading 6104: of man-made fibers: other: other: girls=. The rate of duty will be 29.1% ad valorem.

The infants= jacket falls within textile category designation 239. As a product of Macau, this merchandise is not subject to a visa requirement or quota restraints. The girls= jackets fall within textile category designation 635. As products of Macau, this merchandise is subject to a visa requirement and quota restraints based upon international textile trade agreements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
