RE: The tariff classification of Windshield Wiper Frame and Windshield Wiper Connecting Rods (Linkage) from Germany

Dear Mr. Resetar:

In your letter dated December 16, 1998 you requested a tariff classification ruling.

You supplied diagrams from your parts microfiche system.

All the parts in question are related to the Windshield Wiper System. The Wiper Frame is made of steel. It attaches to a vehicle body panel. The purpose of the frame is to form a base for the Wiper Motor and Wiper Arms.

The Wiper Connecting Rods are made of stamped steel. Connecting Rod #3 (referenced to in the attached diagrams) transfers the power from the Wiper Motor to the Wiper Spindle Flange, located on one end of the Wiper Frame. Connecting Rod #5 connects the Wiper Spindle Flanges of both sides of the Wiper Frame. The purpose of the Connecting Rod #5 is to transfer power from one spindle to the other.

The applicable subheading for the Windshield Wiper Frame will be 8512.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting or signaling equipment, windshield wipers, defrosters and demisters, of a kind used for cycles or motor vehicles; parts thereof: Parts: Other. The rate of duty will be 2.5% ad valorem. The applicable subheading for the Windshield Wiper Connecting Rods (linkage) will be 8512.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting or signaling equipment, windshield wipers, defrosters and demisters, of a kind used for cycles or motor vehicles; parts thereof: Parts: Other. The rate of duty will be 2.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
