RE: The tariff classification of soft sided cooler bag from China.

Dear Mr. Neal:

In your letter dated December 15, 1998 you requested a classification ruling.

The submitted sample, designated as style JFG-AM60, is a soft sided bag designed to store and preserve food or beverages over time by maintaining the appropriate temperature with the aid of a cold pack which is added to the product after importation.. The bag is rectangular in shape and measures approximately 12" X 8" X 6". It is characterized by a zippered closure that extends three quarters of the way around the top of the bag, two woven textile carrying straps and an interior that is separated into two compartments. The bag is manufactured using a three layer construction. The outer layer of the front, back, top and one side is manufactured using a plain woven fabric composed of 53.4% ramie and 46.6% polyester which has been coated on one side with an embossed layer of non-cellular plastic. The uncoated textile surface of this material faces the outside. The outer layer of the bottom and one side of the bag is constructed from cellular plastic sheeting which has been backed with plain woven man-made fiber fabric. The middle layer which forms an insulating and shock absorbing layer on all sides and the top and bottom of the bag is manufactured from cellular plastic sheets approximately 5/16" in thickness. The final inner layer used in the construction of this bag is the liner which is manufactured from woven nylon fabric. The applicable subheading for the cooler bag will be 6307.90.9909, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...other, other other, cooler bags with an outer surface of textile materials, other. The duty rate will be 7 percent ad valorem.

This bag falls within textile category designation 870. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
