RE: The tariff classification of a "Packyard" from China and Sri Lanka.

Dear Ms. Van Den Broeke:

In your letter dated November 26, 1997, on behalf of Jinwoong Inc., Fremont, California, you requested a tariff classification ruling.

The submitted photographs depict a "Packyard". It will be made of either nylon, nylon taffeta or polyester woven fabrics. The article is designed to provide a privacy wall, wind block shield or serve as a restraint device for people, teams, children or pets. The article can be used at the beach, park, picnic areas, or any outdoor activities. It measures approximately 2 feet high and will be of varying lengths. There are sleeve openings at set intervals for the insertion of support poles made of plastic tubing.

This ruling applies only to the "Packyard" because it is not clear if the bag depicted in the photographs is being imported with the article. If the bag and the "Packyard" will be imported together or you would like a ruling on the bag, please submit the actual samples and give full details on the imported articles. Please explain what will be imported, how it will be packed and provide the component materials used in the production of the bag.

The applicable subheading for the "Packyard" will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other. The duty rate will be 7 percent ad valorem.

Articles which are classifiable under subheading 6307.90.9989, HTS, which are products of Sri Lanka are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
