RE: The tariff classification of glass nuggets from China and/or Hong Kong

Dear Ms. Wood:

In your letter dated September 15, 1997, on behalf of your client, Hobby Lobby Stores, you requested a tariff classification ruling regarding glass nuggets.

The subject merchandise, which you describe as "glass deco marbles", consists of clear glass nuggets measuring approximately 16mm to 18mm in diameter. Each nugget has one flat side. You indicated that the same size nuggets can also be completely round. This item is to be used for various decorative purposes such as aquariums and floral arrangements.

In your letter you indicated that this merchandise can be imported in two ways: 1) packaged in nets ready for retail sale; or 2) imported in bulk. If imported in bulk, the importer will be repackaging them for retail sale. For tariff purposes the classification will remain the same regardless of how the merchandise is being packed.

The applicable subheading for the glass nuggets will be 7018.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass beads, imitation pearls, imitation precious or semiprecious stones and similar glass smallwares: other. The rate of duty will be 1.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
