RE: The tariff classification of vehicle parts and accessories from Germany

Dear Mr. Gonzalez:

In your letter dated September 10, 1997, you requested a tariff classification ruling on behalf of BMW of North America of Spartanburg, South Carolina.

The first item (shown below) is a three-dimensional, silver, hard plastic number 3 with a black, sticky filling inserted within the grooves of it's back which measures 1¬"L X 2¬"W.

You state that the item is used as part of an automobile model number and is attached to the outside of a vehicle body.

The second item (shown below) is a small, torch-shaped piece of black, soft plastic whose "flame" portion separates into three prongs and measures 1¬" in length.

You state that this item is used to secure motorcycle trim panels.

The applicable subheading for the Emblem ( Part #51 14 8 399 310) and the Rivet ( Part #46 63 1 233 909) will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for Other articles of plastic . . . : Other: Other: Other. The rate of duty will be 5.3% ad valorem.

The last item (shown below) is a black, grained, elephant-shaped piece of malleable plastic measuring 4"L X 5 "W.

You state that the purpose of this item is as an external body trim fitting for a vehicle.

The applicable subheading for the Cap ( Part #51 13 1 932 869) will be 8708.29.5060, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of . . . motor vehicles . . . : Other parts and accessories of bodies: Other: Other: Other. The rate of duty will be 2.7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
