RE: The tariff classification of a plaster figurine from China

Dear Ms. Aldinger:

In your letter dated August 18, 1997, you requested a tariff classification ruling regarding a plaster figurine. A representative sample was submitted and sent to our Customs laboratory for analysis.

Item #972592, which is identified as "Decorated Pig", is part of an assortment of six figurines. Our laboratory has determined that this article is composed essentially of gypsum (plaster).

The applicable subheading for the plaster figurine will be 6809.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of plaster or of compositions based on plaster: other articles. The rate of duty will be 2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
