RE: The tariff classification and status under the North American Free Trade Agreement (NAFTA), of pants from Mexico; Article 509

Dear Ms. Jacobs:

In your letter dated September 30,1997 you requested a ruling on behalf of your client, QST Industries, Inc., on the status of pants from Mexico under the NAFTA.

Jeans or trousers will be cut and sewn in Mexico from U.S., Canadian or Mexican made fabric made from yarns formed in North America from fibers formed in North America. The pocketing material of the garments will be produced in a non-Nafta country.

The applicable tariff provision for the garments will be headings 6203 and 6204, Harmonized Tariff Schedule of the United States Annotated (HTSUSA).

The component that determines the tariff classification of the good, being wholly obtained or produced entirely in the territory of a NAFTA country, will meet the requirements of HTSUSA General Note 12(r)(iii) and 12(t)/62 Chapter rule 3. The complete good will therefore be entitled to a preferential rate of duty under the NAFTA upon compliance with all applicable laws, regulations, and agreements.

This ruling is being issued under the provisions of Part 181 of the Customs Regulations (19 C.F.R. 181).

This ruling letter is binding only as to the party to whom it is issued and may be relied on only by that party.
