RE: The tariff classification of a food ingredient from Canada.

Dear Mr. Ells:

In your letter dated September 2, 1997, you requested a tariff classification ruling.

A sample and an ingredients breakdown was submitted with your letter. The sample was examined and disposed of. The Mayo Spice Bag contains a cream colored powder said to consist of 70.6 percent sugar, 23.5 percent salt, and 5.9 percent spice. The product will be used as an ingredient in the manufacture of a salad dressing.

The applicable subheading for the Mayo Spice Bag will be 2106.90.9400 HTS, which provides for food preparations not elsewhere specified or included...other...other...articles containing over 65 percent by dry weight of sugar described in additional U.S. note 2 to chapter 17...other. The rate of duty will be 31.4 cents per kilogram plus 9.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
