RE: The tariff classification of work gloves from Malaysia.

Dear Mr. Kindler:

In your letter dated September 2, 1997 you requested a tariff classification ruling. The sample provided will be returned as requested.

A partially coated work glove, identified as style #605, was submitted for our examination. The body of the glove is made from knitted cotton fabric and there is an applied rib-knit cuff. A heavy coating of textured PVC, which you state represents 63 percent of the total weight, covers all but the section directly over the back of the hand, wrist, and the lower portion of the fingers. The essential character of the glove is clearly imparted by the coated area.

The applicable subheading for item #605, coated work glove, will be 6116.10.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: Impregnated, coated or covered with plastics or rubber: Other: Without fourchettes: Other: Other... The rate will be 11.9 percent ad valorem.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
