RE: The tariff classification of three women's boiled wool knitted vests from Hong Kong

Dear Ms. Dodeman:

In your letter dated August 20, 1997, you requested a tariff classification ruling.

The submitted samples, Style 8250, 8251 and 8254, are women's vest constructed of 100% finely knitted boiled wool fabric. Style 8250 has a deep V-neckline, oversized armholes, a full zipper front closure, two front pockets with zipper closure, princesss panels on the front and back, side vents and overcast stitching at the neckline, armholes and the bottom. Features on style 8251 include a V-neckline, a four button right over left front closure, oversized armholes, two front patch pockets, back and front princess panels and rib knit binding around the neck, placket, armholes and bottom. The final garment, style 8254, has rib knit binding which finishes the neckline, armholes, placket and bottom; three frog type closures; and three rows of embroidery outlining the front of the vest.

The applicable subheading for the vests will be 6110.10.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats(vest) and similar articles, knitted or crocheted: of wool or fine animal hair: other: vests, other than sweater vests: women's or girls'. The rate of duty will be 16.7%.

Styles 8250, 8251 and 8254 fall within textile category designation 459. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.

Sincerely,

Kevin Weeks
Port Director
