RE: The tariff classification of a woman's dress and shirt from Costa Rica, Columbia and the Dominican Republic

Dear Ms. Smith:

This letter is a correction of the previously issued letter.

In your letter dated July 11, 1997 you requested a tariff classification ruling.

The garments submitted, styles 712546 & P and 712545 & P, consist of a woman's dress and shirt. Both garments are constructed of a woven 97% polyester, 3% spandex fabric.

The dress, style 712546 & P, features a partial front opening secured by a four buttoned closure, a shirt collar, long, hemmed sleeves and a hemmed bottom. The dress extends to just above the knee.

The shirt, style 712545 & P, features a full front opening secured by a six buttoned closure, a shirt collar, long sleeves with single-button cuffs and a hemmed bottom with side vents. The garment also has a pocket in the left chest area. The samples submitted for Customs examination will be returned to you under separate cover.

The applicable subheading for the dress will be 6204.43.4030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of synthetic fibers: other: other: women's. The rate of duty will be 16.7 percent ad valorem.

The applicable subheading for the shirt will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirtblouses: of man-made fibers: other: other: women's. The rate of duty will be 28.1 percent advalorem.

The dress falls within textile category designation 636 and the shirts falls within textile category designation 641. Based upon international textile trade agreements, products of Columbia and the Dominican Republic are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
