RE: The tariff classification of spectacle cases and utility purses from China.

Dear Mr Schiller:

In your letter dated March 25, 1993, on behalf of Uptown Limited, you requested a tariff classification ruling for spectacle cases and utility purses.

You have submitted four samples with your request. They are style numbers 139, 140, 141 and 142.

Styles 139 and 140 are spectacle cases composed of two components. The front exterior of the cases is wholly covered with glass beads. The rear exterior is composed of 100% acetate satin. The glass beads impart the essential character. The cases are secured by means of textile zipper closures at one end. They measure approximately 7 1/4" x 4".

Styles 141 and 142 are utility purses composed of two components. The front exterior of the purses is wholly covered with glass beads. The rear exterior is composed of 100% acetate satin. The essential character is the beads. The purses measure approximately 7 1/4" x 4". They are secured by means of top textile zipper closures.

Your samples are being returned as you requested.

The applicable subheading for Styles 139 and 140, the spectacle cases essentially of glass beads, will be 4202.39.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag: Other, Other. The duty rate will be 20 percent ad valorem.

The applicable subheading for Styles 141 and 142, the utility purses essentially of glass beads, will be 7018.90.5000, HTS, which provides for Glass beads... and articles thereof... Other, Other. The duty rate will be 6.6 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
