Dear Ms. Hyde:

In your letter of March 30, 1993, your ask for instructions as to required country of origin marking to be placed on printed bar code labels which you are developing, for use at all your facilities in the United States and offshore.

Your firm is described as a major electronic component manufacturer, with worldwide operations, and you are aware of the Customs requirements as to marking being legible, conspicuous and indelible. We understand, from the "Molex Bar Code Label Specifications" which you furnished, that these labels are to be applied to storage and shipping packages and containers, which will contain foreign-made articles.

Specification 1.5.2.1.2, at page 4 of the specifications, provides for inclusion on the label of a field called "Made In" (Country of origin), and this is exemplified by Figure 3.1, at page 15 of the specifications. Presumably, a 3.1 type label will be affixed to each package and container, and the country named will be the country of origin of the article contained. If Molex, Inc.'s business practice is such that all imported articles will reach ultimate purchasers in the United States, in sealed packages or containers, which bear 3.1 type labels as described, appropriately placed on the package or container; and, assuming there are no special published marking requirements for a particular class of article being imported, then it is our view that such articles will be marked in full compliance with Customs law and regulation.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
