RE: The tariff classification of ceramic machinery parts from Japan.

Dear Mr. Bentz:

In your letter dated August 22, 1990, you requested a tariff classification ruling.

At issue is the classification of link injectors (Part #3028447) and link injector plungers (Part #3062674), made of ceramic, which are parts for fuel injection pumps.

You suggest that the parts are classifiable under the provision for parts of fuel injection pumps for compression-injection engines in subheading 8413.91.0000, HTS. However, Note 1(b) of Chapter 84 states that the chapter does not cover appliances or machinery or parts thereof, of ceramic material (chapter 69). Since the parts in question are of ceramic they are precluded from classification in chapter 84 even though the unit they are a part of is basically made of metal.

The applicable subheading for the ceramic machinery parts (#3028447 and #3062674) will be 6909.19.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other ceramic wares for laboratory, chemical or other technical uses of other than of porcelain or china. The rate of duty will be 8 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
