RE: Pre-entry classification of children's wearing apparel.

Dear Mr. Maleh:

Pre-entry classification is a program to provide importers with classification advice prior to importation and entry. This shifts the emphasis of the classification function from transaction based analysis after importation to up-front advice for future importation. It promotes voluntary compliance, uniformity and accuracy.

The final review of the pre-entry classification determinations which were conducted at your premises on July 6, 1990 by National Import Specialist Bruce Kirschner has been completed and approved by the National Import Specialist. A listing of the items which were pre-entry classified is enclosed.

As of the date of this ruling, all Customs ports will accept entry of this merchandise at the pre-entry classification tariff numbers. As the importer, you agree to enter according to this advice. Failure to comply will result in your disqualification from participation. You must also advise National Import Specialist Bruce Kirschner of all changes or modifications made to items which have been pre-entry classified and any new items you wish to submit for consideration.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs Office. This ruling under the Harmonized Tariff Schedule of the United States (HTS) is being issued in accordance with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this letter and the enclosed listing of pre-entry classified merchandise should be given to your broker and all members of your staff who are involved with clearing merchandise through Customs.
