RE: The tariff classification of a side battery bolt (screw) from Taiwan.

Dear Mr. Liberati:

In your letter dated May 2, 1990, on behalf of your client, MSW International Inc., you requested a tariff classification ruling.

This steel fastener is called a side battery bolt. It has the design characteristics of a screw. The shank is threaded and it is about 7/16 inch long and 3/8 inch in diameter. The head is an oversized flange hex head with the circular flange portion measuring about 3/4 inch in diameter. A shoulder above the flange is circular and measures about 1/2 inch in diameter and 3/16 in height. Atop the shoulder is a hex head which measures about 5/16 across the flats.

The applicable subheading for the screw will be 7318.15.8060, Harmonized Tariff Schedule of the United States (HTS), which provides for screws having shanks or threads with a diameter of 6mm or more.... The rate of duty will be 9.5 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
