RE: The tariff classification of a looseleaf binder from Taiwan.

Dear Mr. Bernstein:

In your letter dated December 19, 1989 you requested a tariff classification ruling.

You provided a sample of the looseleaf binder with your letter. The looseleaf binder measures 9" x 7-1/8" and consists of a three ring binder mechanism fitted to covers which are made of rejected circuit board material. The looseleaf binder is considered a composite good for tariff purposes and will be classified based on the component that gives the article its essential character.

The applicable subheading for the looseleaf binder will be 8305.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for fittings for looseleaf binders or files of base metal. The rate of duty will be 5.7 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
