RE: The tariff classification of the "Hair Care and Bag Set" from China.

Dear Ms. Shira:

In your letter dated September 26, 1989, on behalf of your client Creative Designs Intl. Ltd., you requested a tariff classification ruling.

The prospective import, the "Hair Care and Bag Set", style #8399, consists of the following:

1. a child's shoulder bag constructed of cellular plastics 2. two elasticized plastic ponytail holders 3. two plastic barrettes or hair clips
4. a toothed headband

The applicable subheading for the the pony tail holders and the plastic barrettes (hair ornaments) will be 9615.11.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other combs, hair-slides and the like: not set with imitation pearls or imitation gemstones: of hard rubber or plastics. The rate of duty will be 5.3 percent ad valorem.

The applicable subheading for the toothed headband (comb) will be 9615.11.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for combs, valued over $4.50 per gross, of plastics. The rate of duty will be 28.8 cents per gross plus 4.6 percent ad valorem.

The applicable subheading for the shoulder bag will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, with outer surface of plastic sheeting. The rate of duty will be 20 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
