RE: The tariff classification of ribbons and trim from Taiwan

Dear Ms. Lopez:

In your letter dated August 6, 1997 you requested a classification ruling on behalf of your client Allstate Floral and Craft Incorporated.

You have submitted two samples of ribbons and one sample of an ornamental trimming which are used for decorative purposes. The two ribbons are 2.5" wide and 10 feet long, woven and consist of two materials sewn back-to-back. One ribbon has a floral pattern (item #AR6428) and the other has a plaid pattern (item #AR6418). Both ribbons have a woven gold-colored reverse side and finished edges with wires enclosed to maintain shape. They are said to be composed of 55% metallic and 45% cotton fibers.

The ornamental gold trimming (item #AR8526-GO) is 2.5" wide and ten feet long with two-thirds woven fabric and the center third an open work knit fabric in a diamond pattern. The three portions of this material are sewn together lengthwise. The trim has edges finished by a hem stitch enclosing a wire to maintain the shape. The trim is composed of 80% metallic and 20% man-made fibers.

The applicable subheading for item numbers AR6428 and AR6418 will be 5806.39.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for narrow woven fabrics,...: Other woven fabrics, other than goods of 5807; other woven fabrics: Of other textile materials: Other; of metalized yarn. The duty rate will be 2.1% ad valorem.

The applicable subheading for item number AR8526-GO will be 5808.90.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for ... ornamental trimmings in the piece, without embroidery, other than knitted or crocheted ... of other than cotton or man-made fibers. The rate of duty will be 6.6% percent ad valorem. There are no textile restraints for this item number.

The ribbons fall within textile category designation 229. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
