RE: The tariff classification of a turban, mirrored ball and key rings from Taiwan.

Dear Mr. Waters:

In your letter dated July 8, 1997, on behalf of Morris Costumes, you requested a classification ruling.

The submitted samples are a turban, mirrored ball with motor and key rings. The turban consists of knit 85% nylon lame and 15% polyester fill. The mirrored ball is valued at $12.70 each and has a A/C motor that is single phase with 23 watts. The key rings are metal with a plastic ballet slipper ornament.

The applicable subheading for the turban will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for Hats and other headgear, knitted or crocheted, or made up from lace, felt, or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Not in part of braid Other: Other. The duty rate will be 33.8 cents/kg + 12% ad valorem.

The applicable subheading for the mirrored ball with motor will be 7013.99.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for Glassware of a kind used for table, kitchen, toilet, office...of heading 7010 or 7018: Other: Other: Other: Other: Valued over $5 each. The duty rate will be 6.3% ad valorem.

The applicable subheading for the key rings will be 7419.99.5050, Harmonized Tariff Schedule of the United States (HTS), which provides for Other articles of copper, other, other, other, other. The duty rate will be 5% ad valorem.

The turban falls within textile category designation 659. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
