RE: The tariff classification of tents from Sri Lanka.

Dear Ms. Waits:

In your letter dated June 19, 1997, on behalf of Safesport Manufacturing, you requested a classification ruling.

The following samples were submitted:

1. A backpacking tent, item number 38-201. It is referred to as the "Clip Corona" two persons bivouac tent. The tent is made of nylon fabric. It has a floor area of approximately 27 square feet, a weight of 6.6 pounds and a carry size of 19 inches long by 5.5 inches in diameter.

2. A backpacking tent, item number 38-221. It is referred to as the "Clip Sirius" two person hexagonal dome tent. The tent is constructed of nylon fabric. It has a floor area of approximately 39 square feet, a weight of 5.9 pounds, and a carry size of 26.5 inches long by 6 inches in diameter.

3. A tent, item number 38-345. It is referred to as the "Clipsilver III" three person hexagonal dome tent. The tent is composed of nylon fabric. It has a floor area of approximately 60 square feet, a weight of 15.8 pounds and a carry size of 25 inches long by 5.5 inches in diameter.

The applicable subheading for item numbers 38-201 and 38-221 will be 6306.22.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for tents: Of synthetic fibers: Backpacking tents. The duty rate will be 3.2 percent ad valorem.

The applicable subheading for Item number 38-345 will be 6306.22.9030, HTS, which provides for tents: Of synthetic fibers: Other, other. The duty rate will be 9.6 percent ad valorem.

Articles classifiable under subheading 6306.22.1000, HTS, which are products of Sri Lanka are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

The Generalized System of Preferences (GSP) expired on midnight May 31, 1997. If the program is renewed by Congress, articles classifiable under subheading 6306.22.1000, HTS, will be entitled to duty free treatment under the GSP upon compliance with all applicable regulations.

The tent, item number 38-345, falls within textile category designation 669. Based upon international textile trade agreements products of Sri Lanka are subject to the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
