RE: The tariff classification of women's garments from Taiwan

Dear Ms. He:

In your letter dated May 27, 1997, you requested a classification ruling.

The first submitted sample, style 8017P, is women's trousers of 96% polyester, 4% spandex rib-knit fabric. The trousers feature an elastic waistband and hemmed cuffs.

The second submitted sample, style 8019, is women's trousers of 100% polyester knit fabric. The trousers feature an elastic waistband, two side pockets, and hemmed cuffs.

The third submitted sample, style 8018, is a woman's shirt of 75% polyester, 25% rayon knit fabric. The shirt is knit with more than 10 stitches per centimeter in both a horizontal and vertical direction, and features a mock turtleneck, partial front opening with zippered closure, long hemmed sleeves, hemmed bottom, four inch side slits, and a left front inset pocket with zippered closure.

Your samples will be returned as requested.

The applicable subheadings for styles 8017P and 8019 will be 6104.63.2011, Harmonized Tariff Schedule of the United States (HTS), which provides for trousers, bib and brace overalls, breeches and shorts, of synthetic fibers, other, other, trousers and breeches, women's, other. The duty rate will be 29.5%.

The applicable subheading for style 8018 will be 6106.20.2010, HTS, which provides for women's or girls' blouses and shirts, knitted or crocheted, of man-made fibers, other, women's. The duty rate will be 33.8%.

Styles 8017P and 8019 fall within textile category designation 648. Style 8018 falls within textile category designation 639. Based upon international textile trade agreements, products of Taiwan are subject to quota and the requirements of a visa.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
