RE: The tariff classification of Christmas pins, earrings, necklace and barrette from Taiwan.

Dear Mr. Stringfield:

In your letter dated June 6, 1997, on behalf of American Drug Stores, Inc., you requested a tariff classification ruling.

You have submitted the following samples with your request:

1. One pair of Christmas earrings consisting of gold toned plastic bells attached to red, black and gold textile bows, suspended from base metal fishhook earwires. The essential character of the earrings is derived from the plastic bells.

2. A Jingle Bell necklace consisting of a large gold toned metal bell with a Christmas motif affixed to a textile cord. The essential character of the necklace is derived from the metal jingle bell.

3. A Christmas barrette consisting of a gold toned textile reindeer's head affixed to a red, green and gold textile bow which is attached to a metal spring clasp.

4. A Christmas pin consisting of a Santa head of man made fibers attached to a bar-type clasp.

5. A Christmas pin consisting of a plastic ornament affixed to a textile ribbon of man made fibers attached to a bar-type clasp.

Your samples are being returned as requested.

The applicable subheading for the Christmas earrings will be 7117.90.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for Imitation jewelry: Other: Other: Valued over 20 cents per dozen pieces or parts: Other: Of plastics. The rate of duty will be free.

The applicable subheading for the Jingle Bell necklace will be 7117.19.9000, HTS, which provides for Imitation jewelry: Of base metal, whether or not plated with precious metal: Other: Other: Other. The rate of duty will be 11 percent ad valorem.

The applicable subheading for the Christmas barrette will be 9615.19.6000, HTS, which provides for Combs, hair-slides and the like: Other: Other. The rate of duty will be 11 percent ad valorem.

The applicable subheading for the Santa head pin will be 9505.10.5020, HTS, which provides for Festive, carnival or other entertainment articles... Articles for Christmas festivities and parts and accessories thereof: Other: Other: Other. The rate of duty will be free.

The applicable subheading for the textile ribbon pin will be 6217.10.9530, HTS, which provides for Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other....Of man-made fibers. The duty rate will be 15.2 percent ad valorem.

The textile ribbon pin falls within textile category designation 659. As a product of Taiwan this merchandise may be subject to visa requirements and quota restraints based upon international textile trade agreements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
