RE: The tariff classification of a rotating UPS (Uninterruptable Power Supply) system from Belgium

Dear Mr. Cresens,

In your letter dated October 22, 1996 you requested a tariff classification ruling.

The merchandise is the "No-Break KS", which is a "dynamic rotating UPS (Uninterruptable Power Supply)" system. This system consists of a diesel engine, an electro-magnetic clutch, and a "stato-alternator" all mounted on a rigid frame chassis, and a choke power panel and a "PLC" control panel. Tariff heading 8502 covers "Electric generating sets, ..., Generating sets with compression-ignition internal combustion piston engines (diesel or semi-diesel engines). For tariff purposes, the expression "generating sets" applies to the combination of an electric generator and any prime mover other than an electric motor.

The applicable tariff classifications for the "No-Break KS" UPS system imported together, will be: 8502.11.0000, Harmonized Tariff Schedule of the United States (HTS), for systems of an output not exceeding 75 kVA; 8502.12.0000, Harmonized Tariff Schedule of the United States (HTS) for systems of an output exceeding 75 kVA but not exceeding 375 kVA; 8502.13.0020, Harmonized Tariff Schedule of the United States (HTS), for systems of an output exceeding 375kVA but not exceeding 1000 kVA; 8502.13.0040, Harmonized Tariff Schedule of the United States (HTS), for systems exceeding 1000 kVA. The rates of duty will be 2.8 per cent ad valorem for tariff subheadings 8502.11 and 8502.12, and 2.6 per cent ad valorem for tariff subheading 8502.13.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
