RE: The tariff classification of an infant carrier covers from China.

Dear Mr. McKelvey:

In your letter dated September 18, 1996, on behalf of W & C International, Inc., Minneapolis, Minnesota, you requested a tariff classification ruling.

The samples submitted were two covers designed to fit over an infant carrier. The sample designated as item number 1 is made of nylon woven fabric with the two side panels constructed of open-work knit fabric. The article features a center opening that is held closed with strips similar to the VELCRO brand loop fastener. The opening is trimmed with a web fabric and has two web straps attached onto the center. Sewn into the edge is an elastic stretch cord. Attached onto the edge are 7 inch long strips that are similar to the above fastener. The sample designated as item number 2 is composed of nylon woven fabric with one side panel made of open-work knit fabric. It features a center opening that is held closed with strips similar to the VELCRO brand loop fastener. On each side of the center opening is a clear plastic material window. Sewn over each plastic window is a textile flap that is held closed with the same above strips. Sewn into the edge is an elastic stretch cord. Attached onto the edge are 7 inch long strips similar to the above fastener. The covers measure 17 1/2 inches long by 21 1/2 inches wide. The samples are being returned as requested.

The applicable subheading for the infant carrier covers will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
