Dear Mr. Baskin:

We are returning your request for a classification ruling, and any related samples, exhibits, etc., because of non-conformity with the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). Additional information is required as indicated below:

The issue of textile costumes is currently pending before the Court of International Trade and under Part 177 of the Customs Regulations (C.F.R. 177) this office is therefore precluded from issuing rulings which involve matters currently before the court. We are therefore returning your request for a classification ruling along with any related samples, exhibits, etc.

We have however examined the subject costume, (hush puppy) for the purpose of offering you a non-binding advice as to the classification for entry purposes. For entry purposes the advisory classification is 6114.30.3070, HTS, which provides for other garments, knitted or crocheted: Of man-made fibers: Other, Other; Women's or girls'.
