RE: The tariff classification of a toy wrist watch from China

Dear Ms. Bernard:

In your letter dated August 20, 1996 you requested a tariff classification ruling.

A sample of the "Barney Wrist Melody" accompanied your inquiry. The item consists of a textile strap, 1 1/2 inches in width, that secures around the wrist via hook and loop fastener material. Attached to the strap is a stuffed representation of a creature's head. The head depicts that of the popular children's character "Barney" and contains a musical chip that plays the "Barney" theme song. To activate the music one simply needs to squeeze the character's head. Underneath the stuffed head is a pictorial representaion of a clock face with printed numbers and hands. Your sample is being returned as requested.

The applicable subheading for the "Barney Wrist Melody" will be 9503.90.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys (except models), not having a spring mechanism. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
