RE: The tariff classification of four jumpers from the Philippines or Sri Lanka.

Dear Ms. Cumins:

In your letter dated August 14, 1996, you requested a classification ruling on behalf of Playknits, Inc., 240 West 40th Street, New York, N.Y.

The submitted samples, styles 6876, 6878, 6879 and 6880, are women's garments. They are manufactured from woven fabric which has been fully lined. The garments are sleeveless with oversize armholes. Style 6876 is constructed from 65% wool, 20% nylon and 15% mohair fabric. It features a full front opening secured by eight buttons, a collar with notched lapels and a self fabric belt. Style 6878 is constructed from 70% wool, 25% polyester and 5% other fiber. It has a round neckline with a partial back opening secure by a zipper. Styles 6879 and 6880 are composed of 40% wool, 35% acrylic, 20% polyester and 5% other fiber. Both have rear partial zipper openings, rounded necklines and self fabric belts. The bottoms of all four garments are hemmed. The samples will be returned as requested.

The applicable subheading for styles 6876 and 6878 will be 6211.41.0040, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for other garments, women's or girls': of wool or fine animal hair: jumpers. The duty rate will be 16% ad valorem.

The applicable subheading for styles 6879 and 6880 will be 6211.43.0064, HTSUSA, which provides for other garments, women's or girls': of man-made fibers: jumpers: containing 36 percent or more by weight of wool or fine animal hair. The duty rate will be 16.8% ad valorem. The jumpers fall within textile category designation 459. As products of the Philippines, this merchandise is subject to a visa requirement and quota restraints based upon international textile trade agreements. As products of Sri Lanka, this merchandise is subject to a visa requirement based upon international textile trade agreements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
