RE: The tariff classification of a girl's vest and pullover from Bangladesh.

Dear Mr. Plenby:

In your letter dated April 8, 1996, you requested a tariff classification ruling.

The submitted samples are described as follows:

Style #ZZ4122 - A girl's 100% polyester, polar fleece sleeveless vest. The garment is knit and features a 2 1/2 inch shoulder width, oversize armholes and a zipper front.

Style #ZZ4128 - A girl's 100% polyester, polar fleece pullover. The garment is knit and features a partial zippered opening at the neck, a standup collar, long sleeves, and side entry, slash, pouch pockets. The sleeve cuffs, collar, front opening, sleeve pockets, and hem are finished with ribbed knit capping in a contrasting color.

You state in your letter that Style #ZZ4122 will be imported in girls' sizes 4-6X. However, your letter did not indicate the size(s) that Style #ZZ4128 will be imported. For purposes of classification, we will assume that the pullover will be imported in girls' sizes 4 -14.

We are returning your samples as you requested. The applicable subheading for the vest will be 6110.30.3035, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers, other, other, other, vests, other than sweater vests: women's or girls'. The rate of duty will be 33.8% ad valorem.

The vest falls within textile category designation 659. Based upon textile trade agreements, products of Bangladesh are presently subject to visa requirements.

The applicable subheading for the pullover will be 6110.30.3055, Harmonized Tariff Scheduled of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vest) and similar articles, knitted or crocheted: of man-made fibers, other, other, other, other: women's or girls' The rate of duty will be 33.8% ad valorem.

The pullover falls within textile category designation 639. Based upon textile trade agreements, products of Bangladesh are presently subject to quota restraints and visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
