RE: The tariff classification of three women's garments from Hong Kong.

Dear Mr. Wilson:

In your letter dated February 9, 1994, you requested a tariff classification ruling.

Style number T3827 is a woman's 100% cotton vest constructed from knit and woven fabric. The front section consists of two plies of fabric (one crocheted and one woven) sewn together as one; the crocheted fabric forms the outer surface of the front of the garment (except for the woven placket). The back section consists of woven fabric. The vest features oversized armholes; a V-neckline; and a full front opening with a 12 button placket. The bottom front has a scalloped edge. The bottom back is hemmed and curved.

The openwork crocheted fabric on the front creates a significant visual effect and renders the essential character of the garment. Harmonized Tariff Schedule of the United States (HTS), General Rules of Interpretation (GRI)3(b).

Style number T6877 is a woman's pullover constructed from 55% ramie, 45% cotton, openwork crocheted fabric. The garment features a scoop-neckline and long sleeves. The sleeve edges and the bottom edge of the garment are scalloped.

Style number T6702 is a woman's vest constructed from 100% cotton, crocheted and jersey knit fabric. The front panels consist of two plies of fabric (one crocheted and one fine jersey knit) sewn together as one; the crocheted fabric is on the outer surface of the front of the garment. The back panel consists of jersey knit fabric. The garment features a deep scalloped V-neckline; short hemmed sleeves; a full front opening with a 2 button closure; a hemmed back and a scalloped front bottom.

The openwork crocheted fabric on the front gives the garment its essential character because it imparts a significant visual effect; HTS, GRI 3(b).

Your samples are being returned as requested.

The applicable subheading for styles T3827 and T6702 will be 6110.20.2035, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters,...waistcoats (vests) and similar articles, crocheted: of cotton: other: vests, other than sweater vests. The rate of duty will be 20.7% ad valorem.

The applicable HTS subheading for style T6877 will be 6110.90.0090, which provides for women's pullovers, crocheted: of other textile materials: other. The rate of duty will be 6% ad valorem.

Styles T3827 and T6702 fall within textile category designation 359. Style T6877 falls in category 838. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
