RE: The tariff classification of ladies' woven blouse and pants from Indonesia

Dear Ms. Muoio:

In your letter dated December 28, 1993, you requested a tariff classification ruling on behalf of Halmode Apparel.

The submitted sample is constructed from fabric that is 100 percent woven rayon. As requested, your sample will be returned to you.

Style 170558 consists of two pieces, a blouse and a pair of pants. The blouse features short sleeves, a V-neckline with a full front opening secured by fifteen self covered buttons. The blouse extends to mid-calf and has 22 inch slits on each side. It was indicated by you that the elasticized piece that is tacked to the center back of the blouse will be sewn into the seams and it will provide better form and fit. The pants have an elasticized back waistband and a side zipper and button closure. The pants reach the ankles and have wide leg openings.

The applicable subheading for the blouse will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls, blouses, shirts and shirt-blouses: of man-made fibers:other: other...other: women's. The rate of duty will be 28.6 percent ad valorem.

The applicable subheading for the pants will be 6204.69.2510, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of other textile materials: of artificial fibers: trousers, breeches and shorts: other...trousers and breeches: women's. The rate of duty will be 30.4 percent ad valorem.

The blouse falls within textile category designation 641 and the pants fall within textile category 648. Based upon international textile trade agreements, products of Indonesia are subject to quota restraints and a visa requirement.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
