RE: The tariff classification of Budesonide (CAS# 51333-22-3), an anti-inflammatory drug, imported in bulk form, from Sweden

Dear Mr. Arcure:

In your letter dated June 16, 1993, you requested a tariff classification ruling.

Budesonide [[product is a mixture of [11-beta, 16-alpha (R), (S)] isomers; chemical name: 16,17-butylidenebis(oxy)-11,21-dihydroxy-[11-beta,16-alpha]-pregna-1,4-diene-3,20-dione]] is a glucocorticoid hormone, which is used as an anti-inflammatory drug. The product will be imported in bulk form, as a powder.

The applicable subheading for Budesonide, imported in bulk form, will be 2937.29.0050, HTS, which provides for hormones, natural or reproduced by synthesis; derivatives thereof, used primarily as hormones; other steroids used primarily as hormones: adrenal cortical hormones and their derivatives: other: other. The rate of duty will be 6 percent ad valorem.

With respect to your request for a tariff classification ruling on inhalers containing Budesonide as the active ingredient, please be advised that your request is being forwarded to U.S. Customs Service Headquarters, Office of Regulations and Rulings, Commercial Rulings Division, Franklin Court, 1301 Constitution Ave., NW, Washington, DC 20029, for their review. A ruling will be issued to you from that office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
