RE: The tariff classification of neoprene rubber gloves from Taiwan.

Dear Mr. Shih:

In your letter dated December 21, 1989, you requested a tariff classification ruling.

Two pairs of sample gloves were submitted. Styles 2001 and 2010 are both made of neoprene rubber laminated to a black knit nylon fabric. Style 2010 features a VELCRO closure at the wrists. The palm area of both styles, consist of knit gray nylon fabric with very small rubber patches for gripping purposes. The gloves are cut and sewn from pre-existing fabric.

The gloves are 90% rubber and 10% nylon by weight. You also indicate that the subject gloves are used in water sports such as water skiing, surfing, scuba diving, wind surfing, jet skiing and fishing.

The applicable subheading for styles 2001 and 2010 will be 6116.10.2510, Harmonized Tariff Schedule of the United States (HTS), which provides for knit gloves, impregnated, coated or covered with plastics or rubber: without fourchettes: cut and sewn from pre-existing machine knit fabric that is impregnated, coated or covered with plastics or rubber: Other...Containing over 50 percent by weight of plastics or rubber. The rate of duty will be 19.8 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
