RE: The tariff classification of a "VAC-N-SAC" power blower accessory kit from Mexico.

Dear Mr. Nottling:

In your letter dated November 20, 1989, on behalf of Allegretti Rowe Inc., you requested a tariff classification ruling.

The VAC-N-SAC consists of two different items packaged together.

1. Two 4.5 inch diameter (about 18" in length) U.S. origin plastic tubes, and

2. One Mexican origin polyester bag with a shoulder strap.

The polyester bag is made in Mexico of stitch bonded fiber fabric and packaged with the two U.S. supplied plastic tubes by their wholly owned subsidiary-Rowe Mexico S.A. de C.V., Juarez, Chihuahua, Mexico. This VAC-N-SAC converts a power blower to a vacuum cleaner which will be used for lawn maintenance. You state that this product will be marketed by either Paramount or Sears.

The applicable subheading for the polyester bag will be 5911.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for textile products and articles for technical uses. The rate of duty will be 7.5 percent ad valorem.

The applicable subheading for the U.S. supplied plastic tubes will be 9801.00.1035, Harmonized Tariff Schedule of the United States (HTS), which provides for American goods returned. The rate of duty will be free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
