RE: The tariff classification of a plastic visor with headband and built-in sunglasses from Korea.

Dear Ms. Meyer:

In your letter dated November 2, 1989, you requested a tariff classification ruling.

The item for which you request a classification is a visor with a headband and built-in sunglasses. A sample was submitted with your letter. The visor is made of polypropylene plastic. The headband is made of cotton, and attaches to the inside of the visor by means of two snaps on each side and Velcro strips in the front. The headband can be removed and washed. A pair of flip-down, unbreakable, rimmed sunglasses, with UV-coated polycarbonate lenses, are built into the visor. The sunglasses do not have temples (the side pieces of a pair of spectacles).

The applicable subheading for the visor with headband and built-in sunglasses will be 9004.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for sunglasses. The rate of duty will be 7.2 percent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

We note that the sample you have submitted is not marked with the country of origin. Products imported into the United States must be marked with the country of origin, in a clear, legible, and conspicuous manner. A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
