RE: The tariff classification of a hair dryer diffuser from Hong Kong or China.

Dear Mr. Follick:

In your letter dated October 17, 1989 you requested a tariff classification ruling on the Conair Model DFO4 Pro Style Diffuser.

Your letter describes the diffuser as a hard plastic, cylindrical cone. The diffuser is designed so that the barrel end of a hair dryer can be securely inserted into the diffuser opening. Heated air passes through the screen-like opening and is gently dispersed over a wider area, imparting greater volume to the hair. The diffuser serves to reduce the air volume emitted from the hair dryer.

Please note that this office never received your sample.

The applicable subheading for the hair dryer diffuser will be 8516.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for electrothermic hairdressing apparatus, parts. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
