RE: The tariff classification of Tipping Cap Needle from Hong Kong.

Dear Mr. Follick:

In your letter dated October 20, 1989, on behalf of Conair Corporation, you requested a tariff classification ruling.

The sample Tipping Cap Needle you submitted consists of a 1 3/4-inch plastic handle and a 1 3/4-inch stainless steel shaft with a minute hook at the end of only 1/32 nd. of an inch. The article is imported in a plastic tube container.

The Tipping Cap Needle is used in dying or bleaching selected strands of a person's hair by placing a plastic cap on the person's head and pulling strands of hair with the hook through the plastic cap. We believe this article to be similar to a crochet hook.

The applicable subheading for the Tipping Cap Needle will be 7319.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for sewing needles, knitting needles, bodkins, crochet hooks, embroidery stilettos and similar articles. The rate of duty will be 5.8 percent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
