RE: The tariff classification of a pirate costume from West Germany.

Dear Ms. Jackson:

In your letter dated October 3, 1989 on behalf of Klein International Ltd., you requested a tariff classification ruling.

One sample garment was submitted. The garment is a child's pirate costume made of a woven blend of polyester and cotton assumed to be chief weight of polyester. The costume is a short sleeve jumpsuit with elastic at the waist and button closure at the back.

The applicable subheading for the Pirate costume will be 6211.43.00207, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: Other garments, women's or girls': of man-made fibers...Girls'. The rate of duty will be 17 percent ad valorem..

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
