RE: The tariff classification of an infant's bib and blanket from Malaysia.

Dear Mr. Ice:

In your letter dated December 7, 1995, on behalf of your client Uptons, you requested a tariff classification ruling.

The merchandise consists of an infant's bib and baby blanket.

The bib, no style number indicated, has a cotton terry knit front which is laminated to a PVC back. The two materials are sewn together along a 1/4 inch wide binding around the edges. The bib front has the embroidered design of a mother duck and three duckling.

The blanket, Style #9365, is a blanket made of cotton knit fabric. It measures approximately 28 x 37 inches and the edges are finished with a strip of blue knit fabric. The face of the towel is printed with animals in primary colors. The back is solid white.

We are returning your samples as you requested.

The applicable subheading for the bib will be 6111.20.6040, Harmonized Tariff Schedule of the United States (HTS), which provides for babies' garments and clothing accessories, knitted or crocheted, of cotton, other, other, other. The rate of duty will be 8.5% ad valorem. The applicable subheading for the blanket will be 6301.30.0020, Harmonized Tariff Scheduled of the United States (HTS), which provides for blankets (other than electric blankets) and traveling rugs, of cotton. The rate of duty will be 9.3% ad valorem.

The bib falls within textile category designation 239. Based upon textile trade agreements, products of Malaysia are presently subject to quota restraints and visa requirements.

The blanket falls within textile category designation 369. Based upon textile trade agreements, products of Malaysia are presently subject to quota restraints and visa requirements.

This binding ruling does not apply to Style #5012216 because an actual sample was not submitted with this request.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
