RE: The tariff classification of shoulder bag from Taiwan.

Dear Mr. Maleh:

In your letter dated September 15, 1995, you requested a classification ruling for a shoulder bag.

The sample submitted, style 608124H, is a girls shoulder bag composed of 100 percent polypropylene straw strips less than 5mm in apparent width. The bag measures approximately 5 inches by 4 1/2 inches with a braided shoulder strap and a flap closure. The flap closure is secured by means of a hook and loop fastener. There is a fabric bow of 100 percent cotton affixed to the exterior flap closure. Your sample is being returned as you requested.

Your reference to label marking requirements noted. Section 304 of the Tariff Act of 1930, as amended provides that, unless excepted, every article of a foreign origin imported into the United States shall be marked in a conspicuous place as legibly, indelibly, and permanently as the nature of the article will permit, in such a manner as to indicate to the ultimate purchaser in the United States the English name of the country of origin of the article. The sample submitted must be marked with a sewn-in fabric label which reads "Made in Taiwan" in a conspicuous location.

Regarding the application of the Textile Fiber Products Identification Act, we recommend that you contact the Federal Trade Commission for addition use of RN numbers.

The applicable subheading for Style 608124H, the girls shoulder bag of 100 percent polypropylene straw strips, will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 19.8 percent ad valorem.

Items classifiable under 4202.22.8050 falls within textile category designation 670. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
