RE: The tariff classification of a children's game from China.

Dear Ms. Koziol:

In your letter dated August 22, 1995, you requested a tariff classification ruling, on behalf of Cadaco.

You are requesting the tariff classification of a children's game, product number 540, referred to in the ruling request as "Lil' Learner Amazing Coloracers". The item is a children's game (no board required) for ages four and older. The game is intended for two players, and may be played on any flat surface. The equipment includes: 2 coloracers(cars), 6 traffic cones, start and finish gates, and a die. The players, in turn, roll the die and move the car until the color in the sunroof matches the color on the die. When the colors match, the turn is completed, and the other player rolls the die. The first player to pass through the finish gate wins the game.

The applicable subheading for the children's game will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for "Articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games; automatic bowling alley equipment; parts and accessories thereof(con.): Other...Other". The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
