RE: The tariff classification of two robes and a cardigan for women from Macau.

Dear Ms. O'Brien:

In your letter dated January 25, 1995, you requested a tariff classification ruling for three garments. The samples are being returned, as you requested.

Style 54105402 is a woman's cardigan constructed from 100% cotton knit pointelle fabric with more than 9 stitches per two centimeters, measured in the horizontal direction. The cardigan features a full front opening with 7 button right over left closure, a rounded neckline with lace trim, and long sleeves with lace trim. Although you have referred to this garment as a bed jacket, neither the styling features, the fabric, nor the submitted advertisement indicates that this garment is a bed jacket.

Style 54104411 is a robe constructed from 100% cotton knit fabric. It is knee length and features a full front zipper opening, two side pockets, and long sleeves with elasticized cuffs.

Style 54105409 is also a robe constructed from 100% cotton knit fabric. It is ankle length and features a four button partial opening, a breast pocket, two side pockets, and short sleeves.

The applicable heading for style 54105402 is 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for knitted sweaters and similar articles, of cotton, for women. The rate of duty will be 20.3 percent ad valorem.

The applicable subheading for both robes will be 6108.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit dressing gowns and similar articles, of cotton. The rate of duty will be 9 percent ad valorem.

Style 54105402 falls within textile category 339; the robes fall within textile category designation 350. Based upon international textile trade agreements, garments imported from Macau are subject to visa requirements and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
