RE: The tariff classification of a woman's blouse and jacket from India

Dear Ms. Decker:

In your undated letter received on October 17, 1994, you requested a classification ruling. Two samples were submitted with your inquiry. As, requested, your samples will be returned to you.

Style 116562 is a blouse constructed from woven fabric that is 88 percent cotton and 12 percent linen. The blouse features a round neckline, long hemmed sleeves, side vents and a full front opening secured by five buttons. The blouse extends to the waist.

Style 125502 is a jacket constructed from woven fabric that is 53 percent rayon, 31 percent cotton and 16 percent linen. The unlined jacket features a collar, long hemmed sleeves and a full front opening secured by seven buttons. The jacket also has two lower patch pockets and a straight hemmed bottom. The jacket extends to mid-thigh.

The applicable subheading for style 116562 will be 6206.30.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of cotton: other: other: with two or more colors in the warp and\or the filling: women's. The duty rate will be 16.4 percent ad valorem.

The applicable subheading for style 125502 will be 6211.43.0078, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of man-made fibers: jackets and jacket-type garments excluded from headings 6202. The duty rate will be 17 percent ad valorem.

Style 116562 falls within textile category designation 635 and style 125502 falls within textile category 341. Based upon international textile trade agreements products of India are subject to quota restraints and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we Suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
