RE: The tariff classification of sterile trauma burn dressings from South Africa

Dear Mr. Koplovsky:

In your letter dated September 19, 1994, on behalf of Nortrade International, Inc., you requested a tariff classification ruling.

The submitted samples consist of sterile burn dressings which have been impregnated with a Melaleuca-based gel. They are suitable for temporary, premedical, first-aid use on burns and scalds, and are applied to the injured body part to provide physical protection against contamination, and to minimize trauma. The dressings are put up in sealed, aluminum-foil packets, and come in various sizes (e.g., 20cm x 20cm, 80cm x 80cm, 1.2m x 1.2m, 2.5m x 1.6m).

The applicable subheading for the subject dressings will be 3005.90.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for: "Wadding, gauze, bandages and similar articles (for example, dressings, adhesive plasters, poultices), impregnated or coated with pharmaceutical substances or put up in forms or packings for retail sale for medical, surgical, dental or veterinary purposes: Other: Coated or impregnated with pharmaceutical substances." The rate of duty will be 2.4 percent ad valorem.

Articles classifiable under subheading 3005.90.1000, HTS, which are products of South Africa, are entitled to duty-free treatment under the Generalized Sytem of Preferences (GSP) upon compliance with all applicable regulations. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
