RE: The marking requirements for watch cases.

Dear Ms. Hudson:

In your letter dated May 16, 1996, you requested a ruling on the marking for watch cases.

Chapter 91, Additional U.S. Note 4(c) of the Harmonized Tariff Schedule of the United States (HTSUS) states:

Watch cases shall be marked on the inside or outside of the back to show:
i. the name of the country of manufacture; and
ii. the name of the manufacturer or purchaser.

Enclosed for your reference is a copy of Additional U.S. Note 4 which details the special marking requirements for watches. Please note the required methods of marking.

You have also requested the rate of duty for watches being imported into North America. In order to issue a ruling, we will need a sample of the watch, or a complete description as to the number of jewels, type of case, type of band, and whether the watch is quartz analog or digital. When this information is available, you may wish to consider resubmission of your request.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Stanley Schwartz at 212-466-5895.

Sincerely,

Roger J. Silvestri
