RE: The tariff classification of air conditioning silencers from Canada

Dear Mr. Davidson:

In your letter dated February 20, 1996, you requested a tariff classification ruling regarding air conditioning silencers. A brochure was submitted with your ruling request.

The silencers are constructed of galvanized steel (solid on the exterior, perforated on the interior) filled with sound absorbing mineral wool. The silencers are available in various sizes and are used to control airborne noises. You stated in a telephone conversation with this office that silencers are used in conjunction with ductwork. In order to reduce noise, a piece of the ductwork is removed and replaced with the silencer.

The applicable subheading for the air conditioning silencers will be 6806.90.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for sounding-insulating or sound-absorbing mineral material, other. The rate of duty will be 2.9 percent ad valorem.

Goods classifiable under subheading 6806.90.0090, HTS, which have originated in the territory of Canada, will be entitled to a free rate of duty under the United States-Canada Free Trade Agreement (FTA) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
