Dear Mr. Pichay:

We are returning your request for a classification ruling, and any related samples, exhibits, etc., because of non-conformity with the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). Additional information is required as indicated below:

Please indicate, if applicable, which articles have more of a utilitarian than functional use.

Please provide, for the subject items, a breakdown of component materials by weight (assuming not all the articles are of ceramic) and with respect to ceramic products, indicate the type of ceramic (e.g., earthenware, stoneware, porcelain, et cetera).

Please indicate the entered unit (fob) values of the tableware and kitchenware articles that have a utilitarian use, noting samples of those items should be submitted for review. Further, all tiles must clearly indicate whether they are glazed or unglazed and samples of ceramic tiles under 7 cm in size should also be submitted for review.

In reference to unglazed, unpainted planters, pots, bowls, vases, plates, boxes and jars without relief, please specify if they possess any type of designs.

The name of the port(s) in which the merchandise will be entered (if known).

A statement that there are, to the importer's knowledge, no issues on the commodities pending before the Customs Service or any other court.

Lengthy requests which involve numerous items will delay the issuance of a response. Therefore, ruling requests should contain not more than 5 items in order to be accepted.

Further, in regard to the articles depicted in this catalog, please be advised that NIS 227 (George Kalkines - telephone number 212-466-5794) only handles ceramic tableware, kitchenware and tiles as well as decorative articles of ceramic and porcelain. NIS 226 (Jacob Bunin - telephone number 212-466-5796)handles the stoneware articles. In regard to items that are made of shell or other sea-related products, you should contact NIS 353 (Martin Weiss - telephone number 212-466-5881). Articles that are considered to be furniture are handled by NIS 233(L.Mushinske - telephone number 212-466-5739).

It is suggested that you contact the above-stated National Import Specialists if you have any questions pertaining to their merchandise and then prepare separate letters, requesting the classification of no more than five items, addressed to the above individuals who will classify these articles.

Moreover, due to the numerous articles contained in your ruling request, you may wish to consider having the subject articles classified under the Customs Preimportation Review Program.

When this information is available, you may wish to consider resubmission of your request. If you decide to resubmit your request, please include all of the material that we have returned to you.
