RE: The tariff classification of note cards, decorated with pictures, from Vietnam.

Dear Mr. Nies:

In your letter dated January 9, 1996, you requested a tariff classification ruling.

Several samples were submitted and will be retained for reference. They are folded paper note cards, suitable for use as stationery, in sizes ranging from 4" x 5 1/2" to 5" x 8 1/2" in closed condition. The face of each card is decorated with a picture or design, either in the form of a watercolor on paper or fabric affixed to the surface, or in the form of pressed bits of flowers glued on in an artistic arrangement. The interiors and backs of the cards are totally blank.

The applicable subheading for the above-described decorated note cards will be 4817.20.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) letter cards, plain postcards and correspondence cards. The rate of duty will be 33%.

Please be advised that the imported cards will be required to be marked with wording such as "Made in Vietnam" or "Product of Vietnam." This country of origin marking must be in a conspicuous place, legible, and sufficiently permanent to reach the ultimate purchaser in the United States.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
